1. Controller

The controller responsible for data processing on this website is:

Klein GmbH Internationale Spedition
represented by the managing directors Goran Panic and Hélder Costa
Klausenburger Str. 9, 81677 Munich, Germany
Phone: +49 89 2 19 60 89-0
Email: info(at)kleinspedition.com

Data protection officer: [KLÄREN: siehe deutsche Fassung – Kontakt des Datenschutzbeauftragten eintragen oder Absatz löschen.]

2. Hosting and server log files

This website is operated by an external hosting provider on servers in a data centre in Germany. We have concluded a data processing agreement with the provider in accordance with Art. 28 GDPR.

Each time our website is accessed, the web server automatically processes data transmitted by your browser:

  • IP address of the requesting device
  • date and time of access
  • requested page or file and amount of data transferred
  • HTTP status code
  • previously visited page (referrer), if transmitted
  • browser type, browser version and operating system

This data is technically required to deliver the website and to ensure its stability and security, for example to detect attacks. The legal basis is our legitimate interest pursuant to Art. 6(1)(f) GDPR. Log files are deleted after 7 days at the latest. Data whose further retention is necessary to investigate a security incident is only deleted once the investigation has been completed. This data is not combined with other data or used for marketing purposes.

3. No cookies, no tracking

Our website itself does not set any cookies and does not use any analytics or tracking services. Fonts and scripts are loaded from our own server; no connection to third-party servers is established when you view our pages. Exceptions are the spam protection of the forms, which is only loaded when you fill in a form (see section 4), and the map on the “Directions” page, which is only loaded with your explicit consent (see section 6).

4. Contact via form, email or phone

We offer three forms on our website:

  • Freight inquiry: company, contact person and phone (mandatory), optionally email, loading and unloading point with date and time, shipment details (quantity, weight, packaging, dimensions, dangerous goods, pallet exchange) and further information
  • Contact: company, last name, first name, street, postcode/city, email and your message (all optional)
  • Call-back service: topics of interest, your inquiry, name, company, phone, fax and email (all optional)

After submission, the data you entered is sent by email to our mailbox together with the date and time of the request. The data is not stored in a database on the web server. To protect against automated spam, the forms also contain a check field that is invisible to humans; no additional data is collected in the process.

Spam protection with Cloudflare Turnstile: In addition, we protect the forms with Cloudflare Turnstile, a service of Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. Turnstile is only loaded when you start filling in a form. Cloudflare processes technical characteristics of your connection and browser, in particular IP address, TLS fingerprint, user agent and the page visited, in order to determine whether the request comes from a human. Cloudflare acts as a processor on our behalf (Art. 28 GDPR). The legal basis is our legitimate interest in protecting our forms against abuse and spam (Art. 6(1)(f) GDPR); the associated access to information on your device is strictly necessary for sending the form at your request (Section 25(2) no. 2 TDDDG). Data may be transferred to the USA; Cloudflare is certified under the EU-US Data Privacy Framework, and standard contractual clauses apply in addition. Further information: Cloudflare Turnstile privacy notice.

If you contact us by email or phone, we process the data you provide in the same way.

We use your details solely to process your request and, if applicable, to prepare an offer. The legal basis is Art. 6(1)(b) GDPR insofar as your request is aimed at concluding or performing a contract, and otherwise our legitimate interest in responding to inquiries pursuant to Art. 6(1)(f) GDPR. Providing your data is neither a statutory nor a contractual requirement; however, we cannot process a freight inquiry without the mandatory details.

Our email mailbox is operated by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland, as a processor (Microsoft 365). Access by Microsoft companies in the USA cannot be ruled out. Microsoft is certified under the EU-US Data Privacy Framework; in addition, standard contractual clauses of the European Commission apply.

5. Job applications

If you apply for a job with us, for example by email or post, we process the data in your application documents in order to decide on establishing an employment relationship. The legal basis is Art. 6(1)(b) GDPR. Insofar as you voluntarily provide special categories of personal data (such as information on a severe disability), we process them in accordance with Art. 9(2)(b) GDPR.

If an employment relationship is established, the documents are transferred to the personnel file. Otherwise, we delete them no later than six months after the end of the application process so that we can defend ourselves against possible claims, for example under the German General Equal Treatment Act (Art. 6(1)(f) GDPR). Longer retention for future vacancies only takes place with your consent (Art. 6(1)(a) GDPR). Please note that unencrypted emails could be read by third parties during transmission.

6. Google Maps

On the “Directions” page you can display a map from Google Maps. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). The map is only loaded when you click “Load map”. Before that, no connection to Google is established.

After you click, your browser transmits data to Google, in particular your IP address, the page visited and information about your browser and device. Google may use cookies or similar technologies in the process. The legal basis is your consent pursuant to Art. 6(1)(a) GDPR and Section 25(1) of the German Telecommunications Digital Services Data Protection Act (TDDDG). Your consent only applies to the respective page view and is not stored. You can withdraw it at any time with effect for the future by reloading the page and not activating the map again.

Data may be transferred to Google LLC in the USA. Google is certified under the EU-US Data Privacy Framework, for which an adequacy decision of the European Commission exists (Art. 45 GDPR); in addition, Google uses standard contractual clauses. Further information: Google Privacy Policy.

7. Recipients and storage period

Within our company, your data is only accessible to employees who need it for processing. External recipients are the processors named in this policy (hosting, email, spam protection) and, with your consent, Google. Beyond that, we only pass on your data if this is necessary to carry out an order (e.g. to carriers involved) or if we are legally obliged to do so.

We only store personal data for as long as is necessary for the respective purpose. We delete inquiries once they have been fully processed. If an inquiry leads to a contract, we retain the related correspondence in accordance with the retention periods under German commercial and tax law (Section 257 HGB, Section 147 AO: six or ten years).

8. Your rights

With regard to your personal data, you have the following rights:

  • right of access (Art. 15 GDPR)
  • right to rectification (Art. 16 GDPR)
  • right to erasure (Art. 17 GDPR)
  • right to restriction of processing (Art. 18 GDPR)
  • right to data portability (Art. 20 GDPR)
  • right to withdraw consent at any time with effect for the future (Art. 7(3) GDPR)

To exercise your rights, simply send a message to the contact details above.

9. Right to object

Insofar as we process your data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you have the right to object to this processing at any time on grounds relating to your particular situation (Art. 21 GDPR). We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

10. Right to lodge a complaint with a supervisory authority

You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:

Bayerisches Landesamt für Datenschutzaufsicht (BayLDA)
Promenade 18, 91522 Ansbach, Germany
Phone: +49 981 180093-0
Email: poststelle@lda.bayern.de
www.lda.bayern.de

11. Further information

Encryption: For security reasons, this website uses TLS encryption (recognisable by “https://” in the address bar). Data you send via the forms is transmitted in encrypted form.

No automated decision-making: We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.

Changes: We will update this privacy policy if our website or the legal situation changes. The version published here applies.

This English version is provided for convenience. In case of doubt, the German version shall prevail.
